Court order on reciprocal import taxes
A US trade court has ordered the Trump administration to refund additional import taxes that were collected under the banner of “reciprocal” tariffs, ruling that the collections were illegal.
Background and legal basis
The extra duties were imposed on imports from several countries, including India, and drew strong opposition both internationally and within the US. The US Supreme Court had earlier held that the President does not have the authority to impose such reciprocal taxes.
Refund process and liquidation timeline
In the US, imports follow a “liquidation” process: an estimated amount is paid when goods enter the country, and the final duty is determined later—around 314 days afterward. The judge has now directed authorities to finalize prices without the disputed tax and return the excess amount, along with interest, to importers.
Scale of repayments
More than 300,000 importers are said to have paid these additional duties after they were introduced. The total refund is estimated at Rs 11.91 lakh crore, marking a major setback for the Trump administration.
