The Bombay High Court has observed that while citizens have the right to protest, demonstrations must remain peaceful. The court also noted that restrictions imposed by police in Maharashtra on protests appear excessive in some instances.
The remarks came while hearing a public interest petition filed by advocate Sagar Devre. The plea alleged that police acted beyond their authority and used coercive measures against those who attempted to protest peacefully in Mumbai.
The petition referred to a protest call issued last week in Mumbai seeking the resignation of Chief Election Commissioner Gyanesh Kumar, as part of demonstrations held in different parts of the country by the “Karappanpoochi” party. It was alleged that four participants were placed under house arrest.
A bench comprising Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna said authorities must also take into account the background of those participating in protests. The court said protesters should not have a criminal background and that criminals cannot be allowed to protest under the cover of being ordinary citizens.
The matter has been adjourned to November 19 for further hearing.
